Terms of Service
The agreement between your business and MYW for use of the platform.
Last updated: 13 August 2026
1. These terms
These terms form an agreement between you (the business using the service) and A1 Solutions Limited (NZBN 9429034593684, company number 1681847), a New Zealand company operating the MYW platform. By creating an account or using the service you accept them.
If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
These terms also cover MYW Social Publishing — the name under which our social media publishing feature is registered with TikTok and with Meta (Facebook and Instagram). MYW Social Publishing is part of the MYW platform and is provided by A1 Solutions Limited under these same terms; using it to publish to a connected account means accepting them.
2. What MYW provides
MYW is a subscription platform that gives a business a website and, depending on the plan and modules chosen, online ordering, product management, job management, workflow tools and social media publishing. Features vary by plan and change over time as we improve the service.
3. Free trial
- New accounts may start a 30-day free trial. No card is required.
- The trial gives access to the full feature set so you can evaluate it properly.
- At the end of the trial, choose a paid plan to continue. If you don’t, your account moves to a limited state and eventually stops being available.
- One trial per business. Trials are for genuine evaluation, not ongoing free use.
4. Your account
- Give accurate information when signing up, and keep it current.
- You are responsible for your account, your users, and everything done under your login.
- Keep your password confidential and tell us promptly if you suspect misuse.
- You are responsible for the users you invite and what they do.
5. Fees and payment
- Subscription fees are shown on our pricing page and charged in advance.
- Payments are processed by Stripe. We never see your full card number.
- Subscriptions renew automatically for the same period until cancelled. Cancel at any time — your plan then runs to the end of the period already paid for.
- Fees are non-refundable except where required by law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986 where they apply.
- If a payment fails, we will tell you and may suspend paid features until it is resolved.
- We will give at least 30 days’ notice by email before changing prices.
6. Your content
You own your content — your text, images, products, prices, logos, and your customers’ data. We claim no ownership of it.
You grant us the limited licence needed to host, store, display and transmit it so we can run the service for you. That licence exists only to operate MYW and ends when you delete the content or close your account.
You are responsible for having the right to use everything you upload, including images and trade marks.
7. Your customers’ information
Where your MYW website collects information from your customers — orders, contact details, bookings — that information is yours and you are responsible for it. We hold and process it on your behalf.
You must:
- have your own privacy policy telling your customers how you use their information;
- comply with the Privacy Act 2020 and, for email or text marketing, the Unsolicited Electronic Messages Act 2007 — which requires consent and a working unsubscribe option;
- only send marketing to people who have genuinely opted in.
8. Connected third-party accounts
You may connect accounts you control — such as Facebook, Instagram, TikTok, Google Business Profile or WhatsApp — so MYW can publish on your behalf.
- You must own or be authorised to manage every account you connect.
- Those platforms have their own terms. Your use of them stays subject to those terms, and they may change or withdraw access at any time.
- We are not responsible for a platform rejecting, delaying or removing your content, or for suspending your account there.
- Some destinations cannot be published to automatically — Facebook Groups, for example, have no publishing API. MYW prepares that content for you to post yourself and marks it accordingly.
9. Acceptable use
You must not use MYW to:
- break any law, or infringe anyone’s intellectual property or privacy;
- send spam or unsolicited marketing;
- publish content that is misleading, defamatory, obscene, or that promotes harm;
- attempt to gain unauthorised access to our systems, other customers’ data, or to disrupt the service;
- resell or white-label the service without our written agreement.
10. Availability
We work to keep MYW available and reliable, but we do not guarantee uninterrupted service. Maintenance, third-party outages and events outside our control can interrupt it. We will give reasonable notice of planned maintenance where we can.
11. Suspension and termination
- You may cancel at any time from your account or by contacting us.
- We may suspend or terminate your account if you materially breach these terms, if fees remain unpaid, or if your use puts the service or other customers at risk.
- Except in cases of serious misuse, we will give you notice and a reasonable chance to put things right first.
- After termination, you have 30 days to export your content. After that we may delete it.
12. Liability
Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot legally be excluded. Where you acquire MYW for business purposes, the parties agree those Acts do not apply to the extent the law permits contracting out.
To the extent the law allows, we are not liable for indirect or consequential loss, including lost profits, lost revenue, lost data or business interruption. Our total liability in any 12-month period is limited to the fees you paid us in that period.
13. Changes to these terms
We may update these terms as the service develops. We will give at least 30 days’ notice by email of material changes. Continuing to use MYW after they take effect means you accept them.
14. Governing law
These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute. Please contact us first — most issues are resolved with a conversation.
